This Participation, Assumption of Risk and Liability Waiver Agreement (“Agreement”) is entered into between:

XELAR Motorsport FZ LLC Licence Number: 7016705 Issued by: Ras Al Khaimah Economic Zone RAKEZ) Operating Location: Al Forsan International Karting Circuit, Abu Dhabi, United Arab Emirates (hereinafter referred to as “XELAR Motorsport”) and The undersigned participant (“Driver”) and/or legal guardian (if the Driver is under 18 years of age).

1. Acknowledgment of Risk

The Driver / Legal guardian acknowledges that karting, motorsport testing, performance programs, and related activities are inherently dangerous and involve significant risks, including but not limited to:

• High-speed collisions
• Mechanical failure
• Loss of control
• Contact with barriers or other vehicles
• Serious bodily injury or death

The Driver / Legal guardian understands that participation in motorsport activities conducted by XELAR Motorsport at any Karting Circuit is voluntary and accepts full responsibility for all risks associated with participation.

2. Assumption of Risk

The Driver / Legal guardian  expressly and voluntarily assumes all risks, known or unknown, arising from participation in any XELAR Motorsport activity, including but not limited to:

• Driver performance assessments
• Full-day performance programs
• Kart testing sessions
• Kart owner practice
• Paddock and pit lane activities

This assumption of risk includes risks arising from the actions of other participants.

3. Release of Liability

To the fullest extent permitted under the laws of the United Arab Emirates, the Driver / Legal guardian  agrees to release, waive, and discharge XELAR Motorsport FZ LLC, its shareholders, directors, managers, employees, contractors, partners, and affiliates from any liability for:

• Personal injury
• Death
• Property damage
• Financial loss
• Any claim, demand, or legal action arising from participation

This release applies whether caused by negligence or otherwise, except in cases of proven gross negligence or willful misconduct as defined under UAE law.

4. Damage Responsibility

The Driver / Legal guardian  agrees to be fully responsible for any damage caused to:

• Kart chassis
• Engine and mechanical components
• Bodywork and accessories
• Team equipment and tools

Any damage resulting from driver error, misuse, failure to follow instructions, or unsafe driving behavior shall be paid in full by the Driver (or legal guardian if applicable).

XELAR Motorsport reserves the right to assess, document, and invoice all repair costs accordingly.

5. Safety Equipment Requirements

The Driver / Legal guardian confirms that they will not participate without proper and adequate safety equipment suitable for competitive 2-stroke karting, including:

• FIA-approved helmet
• FIA-approved Racing suit
• FIA-approved Racing gloves
• FIA-approved Racing shoes
• FIA-approved Rib protector

XELAR Motorsport does not provide personal safety equipment.

6. Compliance with Instructions and Circuit Rules

The Driver / Legal guardian  agrees to:

• Follow all instructions issued by XELAR staff
• Comply with all regulations of the Karting Circuit
• Respect marshals, officials, and other participants
• Maintain professional and safe conduct at all times

Failure to comply may result in immediate removal from the event without refund.

Participation will be denied without adequate safety gear compliant with circuit standards and regulations.

7. Medical Fitness Declaration

The Driver / Legal guardian  confirms that:

• They are medically and physically fit to participate
• They do not suffer from any condition that would make participation unsafe
• They are not under the influence of alcohol, drugs, or prohibited substances.

XELAR Motorsport reserves the right to refuse participation if safety concerns arise.

8. Insurance

The Driver / Legal guardian understands and acknowledges that XELAR Motorsport FZ LLC does not provide personal accident or medical insurance coverage.

The Driver / Legal guardian is responsible for obtaining their own medical and accident insurance coverage.

9. Media & Image Consent

The Driver / Legal guardian grants XELAR Motorsport FZ LLC the irrevocable right to:

• Capture photographs and video recordings
• Use images and footage for marketing, promotional, sponsorship, and social media purposes
• Publish media without compensation

If the Driver is a minor, consent is granted by the legal guardian.

10. Minors

If the Driver is under 18 years of age:

• This Agreement must be signed by a parent or legal guardian
• The guardian assumes full responsibility for the minor’s participation
• The guardian agrees to indemnify XELAR Motorsport FZ LLC against any claims arising from the minor’s participation

11. Indemnification

The Driver / Legal guardian  agrees to indemnify and hold harmless XELAR Motorsport FZ LLC from any claims, legal actions, liabilities, or expenses arising from:

• Participation in XELAR Motorsport activities
• Damage caused by the Driver
• Violation of circuit regulations or safety instructions.

12. Governing Law & Jurisdiction

This Agreement shall be governed by and interpreted in accordance with the laws of the United Arab Emirates.

Any disputes shall be subject to the exclusive jurisdiction of the competent courts of the United Arab Emirates.

13. Entire Agreement

This document constitutes the entire agreement between the parties and supersedes any prior discussions or understandings.

By registering, the Driver confirms that they have read, understood, and voluntarily agree to all terms contained in this Agreement.
