These Terms & Conditions govern all motorsport programs, driver development services, race participation, kart sales, spare parts trading, e-commerce transactions, training sessions, and related activities provided by XELAR Motorsport FZ-LLC (“the Company”).

 

By enrolling in any program, booking a session, purchasing products, or participating in any activity, the Participant and/or their legal guardian agree to be legally bound by these Terms.

1. COMPANY ACTIVITIES

The Company operates under the following licensed activities, including but not limited to:

  • Sports Management and Promotion
  • Sports Events Marketing
  • Lifestyle Development Consultancy
  • Products and Services E-Trading
  • Auto Spare Parts & Components Trading
  • Auto Accessories Trading
  • Cars Used Spare Parts Trading
  • General Trading
  • Digital Content Creation

Operational activities may be conducted at third-party facilities within the UAE, including Al Forsan International Sports Resort, under commercial arrangements.

2. ELIGIBILITY & MINORS

2.1 Minimum participation age is four (4) years.
2.2 Most Participants are minors; therefore, enrollment requires signed consent by one legal guardian.
2.3 The Company reserves the right to verify Emirates ID or passport documentation.
2.4 Participation is not permitted without signed Driver Consent Form and applicable program agreement.

3. PROGRAM STRUCTURE & PAYMENT TERMS

3.1 Two-Stroke Programs (Team Kart & Owner Kart)
  • Fixed duration of 6, 8, or 10 months depending on program tier.
  • 50% of total program fee payable upfront.
  • Remaining 50% payable within eight (8) months.
  • Development (non-race) programs must be paid in full upfront.
  • Championship entry fees are NOT included.
  • Race tyres, transponders, engine rebuilds, and crash damages are NOT included.

Failure to complete payment does not release Participant from financial obligations.

3.2 SWS Four-Stroke Program
  • Monthly subscription basis.
  • Minimum commitment: five (5) months during the season.
  • Subscription auto-renews via Stripe.
  • Late or failed payment may result in suspension until payment is settled.

4. NON-REFUNDABLE POLICY

4.1 All payments are non-refundable.
4.2 Withdrawal from a program does not cancel outstanding balance obligations.
4.3 Championship cancellations do not entitle Participant to refunds.
4.4 Missed sessions are not refundable unless otherwise agreed in writing.

5. DAMAGE & EQUIPMENT LIABILITY

5.1 All crash damages are the sole responsibility of the Participant.
5.2 Replacement parts must be purchased through the Company to ensure quality and homologation compliance.
5.3 Payment for damages must be completed before the next practice or race participation.
5.4 Failure to pay may result in suspension or termination.

Labor costs for repair are included under program structure; parts are not.

6. KART OWNERSHIP & STORAGE

6.1 Team Kart Programs

All karts remain property of XELAR Motorsport FZ-LLC at all times.

6.2 Owner Kart Programs

Kart remains property of Participant but must remain stored with the Company unless written transport responsibility agreement is executed.

Unauthorized removal of kart constitutes material breach of contract.

7. PRACTICE SCHEDULING & TRACK AVAILABILITY

7.1 Practice sessions are subject to track provider scheduling.
7.2 Practice slots may occur between rental sessions as allocated by the circuit.
7.3 The Company does not guarantee fixed time slots.
7.4 Official scheduling communication is conducted via WhatsApp.

8. SAFETY & ASSUMPTION OF RISK

8.1 Motorsport is inherently dangerous.
8.2 The Company provides no medical, accident, or equipment insurance coverage.
8.3 Participants assume full risk of injury, death, or property damage.
8.4 The Company is not responsible for emergency medical services provided by circuits or event organizers.
8.5 Separate liability waiver and consent forms are mandatory.

9. SAFETY EQUIPMENT

9.1 All drivers must use FIA-approved helmet and safety gear.
9.2 The Company may provide limited equipment (e.g., rib protectors) during testing only.
9.3 Failure to comply with safety requirements may result in removal from session.

10. CODE OF CONDUCT

10.1 Aggressive or unsafe driving is prohibited.
10.2 Parent interference in pit lane operations is prohibited.
10.3 Pit lane misconduct is strictly prohibited.
10.4 Social media conduct that harms team reputation may result in termination.
10.5 The Company may remove any Participant at its sole discretion for misconduct.

11. MEDIA & IMAGE RIGHTS

Participation constitutes irrevocable consent for the Company to use images, videos, and likeness of Participants for marketing, commercial, promotional, and digital content purposes without compensation.

Participants may not refuse media usage once enrolled.

12. SPONSORSHIP & BRANDING

12.1 Drivers may secure personal sponsors.
12.2 Sponsor placement on team karts is controlled by the Company.
12.3 Promotion of competing teams during contract term is prohibited.
12.4 Team suits and branding must be worn as instructed.
12.5 Team karts and full-season owner karts must display team branding.

13. ONLINE STORE & KART SALES

13.1 Product sales are subject to stock availability.
13.2 Technical specifications may vary by manufacturer.
13.3 Deposits for karts are non-refundable unless otherwise agreed in writing.
13.4 Manufacturer warranties apply where applicable.
13.5 Payments processed via third-party providers (e.g., Stripe). The Company is not liable for payment gateway disruptions.

14. TERMINATION

The Company may terminate participation for:

  • Non-payment
  • Code of conduct violation
  • Safety breaches
  • Reputational harm
  • Contract breach

No refund shall apply upon termination.

15. FORCE MAJEURE

The Company shall not be liable for delays, suspension, or cancellation due to:

  • Government restrictions
  • Track closures
  • Weather
  • Mechanical failure
  • Championship cancellations
  • War or force majeure events

16. LIMITATION OF LIABILITY

To the fullest extent permitted under UAE law, the Company’s liability shall not exceed the amount paid for the specific service giving rise to claim.

The Company shall not be liable for indirect, incidental, special, or consequential damages.

18. GOVERNING LAW

These Terms & Conditions shall be governed by and construed in accordance with the laws of the United Arab Emirates.

Any disputes shall be subject to the exclusive jurisdiction of the Courts of the United Arab Emirates.
